Sunrise manufactures and sells outdoor furniture. Included in their range of outdoor furniture are sun lounges and deck chairs, which belong to Sunrise’s “Summer” range and are sold under Sunrise’s name. Another manufacturer, Future, also sells outdoor furniture, including sun lounges and deckchairs as part of its “Funtimes” range. The sun lounges and deckchairs in Sunrise’s “Summer” range and Future’s “Funtimes” range are almost identical in shape, design and general appearance, although on close inspection, differences can be observed.

Has the manufacturer of the “Funtimes” range contravened s 18 of the Australian Consumer Law?
