Needs assessments are an essential part of the support that individuals in the criminal justice system rely upon. Needs assessments will help identify what programs and services can help reduce the risk of recidivism for each individual. They also help make sure the right individuals are in the right programs. 

For this assignment, you have the role of community supervisor. You need to submit a 700- to 1,050-word report that summarizes a needs assessment and recommendations for programs for your client, James, for judicial review. You should read about your client’s background.

Specifically, your report should do the following: 

Select a needs assessment methodology for the client. 

Justify the selection of the needs assessment methodology. 

Apply the needs assessment methodology to the client. 

• Summarize a risk assessment for the client. 
• Recommend specific programs for the client. 
• Analyze program elements and requirements (day program or residential, etc.). 
• Analyze the programs for the ability to meet the needs of the individual/fill in gaps in services for the individual.
• Justify program recommendations by showing evidence of the effectiveness of the recommended programs.

In 2001, British-Dutch corporation Unilever attempted to purchase the assets of Ben & Jerry’s Ice Cream. The Board of Directors of Ben & Jerry’s refused the offer. Unilever’s offer was very generous and would have resulted in a major windfall for the shareholders of Ben & Jerry’s.

The Shareholders threatened to sue the Board of Directors for a breach of fiduciary duty arguing the Board of Directors had a duty for care to make good decisions on behalf of the Corporation. And denying the purchase offer violated that duty.

In fear of the lawsuit, the Board agreed to the sell terms. Do you believe the Board of Directors had a duty to accept the buyout offer? And did their failure to accept it amount to a breach of the fiduciary duties owned to the shareholders?

In the world of Corrections, facilities are faced with civil tort claims on a regular basis.  Utilizing what you have learned in this course, you will create a 3-5 page research paper covering tort claims in regards to restraint chair use within a correctional facility.  Your paper will include a section on why confinement officers may utilize a restraint chair and the benefits of their use, as well as the negative aspects of the chair as well.  You will also include research on alternative products that are currently on the market and whether they are a better choice for the corrections setting vs. the restraint chair.

Today, most of the claims brought against directors and officecount n the United States are those alleged in shareholders’ derivative lawsuits. Other nations, however, put more restrictions on the use of such lawsuits. German law, for example, does not provide for derivative litigation, and a corporation’s duty to its employees is just as significant as its duty to the shareholder-owners of the company. The United Kingdom has no statute authorizing derivative actions, which are permitted only to challenge directors’ actions that the shareholders could not legally ratify. Japan authorizes derivative actions but also permits a company to sue the plaintiff-shareholder for damages if the action is unsuccessful.

Assignment:

(1) Research the laws/statutes/rules/court cases governing shareholder derivative lawsuits in one of the nations listed above or any other foreign nation.

(2) In a minimum 250-word post, please:

     (a)  Cite the law/statute/rule/court case governing shareholder derivative lawsuits of the nation you chose; and
