Defendant Dan who is 19 years old is charged with sexual assaulting his then girlfriend Victim Val. At the time of the sexual acts Dan was 18 years old and Val was 15 years old but told Dan she was “legal”. At a hearing on Dan’s motion to dismiss the charges Dan’s attorney calls Val as a witness who testifies that the sexual acts were all consensual and she told Dan she was legal. At the conclusion of Val’s testimony Dan’s attorney asks Judge Martin to dismiss all charges.
